1. (§17.18) Fraud by an Employer

In State v. Duffy, 8 S.W.3d 197 (Mo. App. W.D. 1999), the appellate court upheld the trial court’s conviction of Duffy, an employer, for misdemeanor workers’ compensation fraud. Duffy was a partner in a construction firm and hired a friend, Pannell, to work for the company. Pannell was subsequently injured on the job, filed a workers’ compensation claim, and began to draw benefits.
