I. (§17.1) Introduction

Chapter 287, RSMo, sets out The Workers’ Compensation Law (the Law). The Law details the workers’ compensation system, including:

· who is an employee;

· who is an employer;

· what injuries qualify for benefits;

· what employers’ responsibilities are; and

· the Second Injury Fund.

The Law also provides for criminal penalties for employers who disregard their responsibilities and employees who abuse workers’ compensation benefits. The criminal penalties are found in § 287.128...
