16.1 INTRODUCTION

Most bankruptcy practitioners do not consider themselves experts in criminal law or expect to be in a position to advise their clients on criminal matters. This appears true regardless of whether an attorney focuses primarily on consumer rather than business bankruptcy or on Chapters 7 and 13 cases rather than Chapter 11 cases. The purpose of this chapter is not to instruct the regular or infrequent bankruptcy attorney in the intricacies of criminal law in the context of liquidation or reorganization proceedings but to alert practitioners to the applicability of various federal statutes that create standards of behavior relating to the preparation for, filing of, and participation in a bankruptcy case. 2
