§ 15.5 Attorneys' Fees Awards Under the Arizona Wage Payment Act
Pursuant to A.R.S. § 23-355, if an employer fails to pay wages that are due to an employee, the employee may recover in a civil action against an employer or former employer an amount that is treble the amount of the unpaid wages. In general, when a cause of action is based on a statute, the peripheral involvement of a contract does not in itself support the application of A.R.S. § 12-341.01(A) to a prevailing party's request for attorneys' fees.
