14.8 Bad Faith. In Arizona, insurance contracts “contain an implied promise of good faith and fair dealing which the insurance company owes to its insured.”135 While insurers may be liable in bad faith to insureds, insurance producers generally are not. This is because insurance producers have no contract with the insured and are usually not involved in claims investigations or coverage determinations.136 For a detailed discussion of the tort of bad faith see Chapter 4.
