§ 13.7 Procedures for Obtaining Fees in Probate Court

The procedure for obtaining court approval of attorneys' fees in probate matters is not clearly specified by statute.

As discussed above, in the majority of decedent's estates and trust matters, attorneys' fees are handled without court involvement. In the case of decedents' estates, these issues come before the court on a petition of an interested person in the estate seeking court review of fees paid to attorneys by the estate.
