13.7 Consumer Fraud Act (A.R.S. § 44-1521 et seq.). Consumer fraud is a cause of action separate and distinct from common law fraud.¹²⁵ In enacting the Consumer Fraud Act, Arizona’s legislature sought to provide a remedy for injured consumers who need protection to counteract the disproportionate bargaining power that is typically present in consumer transactions.¹²⁶ Arizona’s Consumer Fraud Statute is contained at A.R.S. §§ 44-1521 et seq.
