13.7.1 Statute of Limitations. A claim arising under Arizona’s Consumer Fraud Act is subject to the 1-year statute of limitations applicable to liability created by statute, rather than the 3-year period for actions arising out of common law fraud.¹³⁰ As with common law fraud claims, an Act claim accrues pursuant to the discovery rule; or, “when the defrauded party discovers or with reasonable diligence could have discovered the fraud.”¹³¹
