2. Statute of Limitations

An action to foreclose a mortgage has a six-year statute of limitations.2105 The six years begins to run (i) from the due date of each unpaid mortgage installment,2106 (ii) from when the mortgagee is entitled to demand payment in full, or (iii) from when the mortgage is accelerated.2107 Even if a mortgage is payable in installments, though, once a mortgage debt is accelerated, the entire amount is due, and the statute of limitations begins to run on the entire debt.2108

Where a defendant raises statute of limitations as a defense to the foreclosure proceeding, and, for example, pursues the defense by moving to dismiss, that defendant bears the initial burden to prima facie show that the time to commence the action expired.2109 If that burden is met, only then does the obligation shift to the plaintiff to demonstrate a question of fact to survive the motion, for examples, setting forth facts to show a tolling of the statute of limitations, showing why the statute of limitations is otherwise inapplicable, and/or showing that the action was timely commenced.2110
