13.1.2.7 Unemployment Compensation

. There is an apparent inconsistency in obtaining workers’ compensation benefits under a theory of disability and applying for unemployment compensation asserting physical ability to work. Accordingly, by statute in most states, unemployment benefits are not paid to persons who are collecting workers’ compensation benefits.^[29] For example, the Illinois unemployment compensation law states that a person is ineligible for unemployment benefits for any week with respect to which the claimant is receiving temporary disability compensation. However, if the workers’ compensation payments are less than the applicant would receive in unemployment benefits, then he or she is entitled to the unemployment benefits reduced by the amount of workers’ compensation.^[30]
