13.1.2.3 Federal Employers Liability Act

. The Federal Employers’ Liability Act (“FELA”)[20] is a purported negligence-based compensation system applicable to interstate rail workers.[21] FELA is the exclusive remedy for interstate rail employees,[22] pursuant both to language in FELA and to language in some state laws excluding persons covered by FELA from state workers’ compensation coverage.[23] According to Larson, the exclusiveness of FELA also bans actions under state employers’ liability acts.[24]
