12.7.6 Privilege for Reports of Sexual Harassment. Arizona state and federal courts have granted a qualified privilege for reports of sexual harassment.¹⁴³ In Miller v. Servicemaster by Rees,¹⁴⁴ the court reasoned that:

[A] conditional privilege exists because public policy dictates that employees must be protected from workplace sexual harassment. . . . That interest can only be protected if employees can report perceived acts of sexual harassment regardless whether the acts were intended to harass.
