12.5.4 Commercial Appropriation of Name or Likeness. Arizona law recognizes the tort of commercial misappropriation of name or likeness as follows:
One who appropriates to his own use or benefit the name or likeness of another is subject to liability to the other for invasion of his privacy.82
An employer may be liable for inappropriately licensing a current or former employee’s name and/or likeness to endorse its products or services.83
