12.5.1 False Light Invasion of Privacy. Arizona law recognizes the tort of false light invasion of privacy as follows:

One who gives publicity to a matter concerning another that places the other before the public in a false light is subject to liability to the other for invasion of his privacy, if (a) the false light in which the other was placed would be highly offensive to a reasonable person and (b) the actor had knowledge of or acted in reckless disregard as to the falsity of the publicized matter and the false light in which the other would be placed.⁶⁵

A false light invasion of privacy claim may arise in the employment context when an employer, for example, falsely or inaccurately attributes a blog or website to one of its employees.⁶⁶ The employer may be sued for false light invasion of privacy, for example, if the employer inaccurately represents the contribution that one of its employees made to an invention or patent.⁶⁷

An employee may assert a claim if its employer reports false or defamatory information about the employee or an employee’s family member in the company’s newsletter.⁶⁸
