12.1 IN GENERAL

Certain key principles permeate discovery issues that Virginia lawyers face. These principles can be implicated by any kind of discovery in which the lawyer is seeking or providing information. They often restrict lawyers' conduct in unpredictable ways. Lawyers who intentionally or negligently stray from these principles may lose efforts to obtain discovery, be forced to reveal information in discovery that they would prefer to have remain secret, or even suffer sanctions.
