12-02 RESIDENTIAL LEASE AGREEMENT

RESIDENTIAL LEASE AGREEMENT

THIS LEASE AGREEMENT (the "Lease") is entered into as of [date], by and between [landlord name] ("Landlord"), and [tenant name] ("Tenant"). Sometimes herein Landlord and Tenant are collectively referenced as the "Parties."

1. LEASED PROPERTY. For and in consideration of the rents, covenants, and agreements herein agreed to by Tenant, Landlord hereby leases unto Tenant the real property located at [leased property address], which may be more particularly described on an Exhibit "A" attached hereto, together with all improvements located thereon (the "Property"), for and during the term herein stated.

2. RENT AND SECURITY DEPOSIT. The rent due for the Property shall be $[rental amount] per month, which shall be due and payable on the first day of each month. If rent has not been paid by the fifth day of the month, a late fee of $[late fee amount] shall be assessed against Tenant as a condition of Landlord's acceptance of the late payment. Rental fees, including any late fees, shall be payable by check or money order made payable to Landlord, at the address set forth in paragraph 14. A security deposit of $[security deposit amount] shall be required at commencement which shall not be used for the last month's rent.

3. TERM. This Lease shall be for a period of [lease term] year[s], beginning on the date hereof and ending on [term ending date].

4. SECURITY DEPOSIT. At Lease termination, Landlord shall comply with all state laws regarding security deposits, which deposit shall be refunded to Tenant (less any unpaid amounts used for rent or damage with a written notice to Tenant).

5. USE OF PROPERTY. Only the person(s) whose name(s) appear(s) on this Lease as Tenant and their children may occupy the Property. The Property shall be occupied solely for the purpose of private housing. Tenant shall not commit waste, nor permit waste to be committed on the Property. Tenant shall not park, nor allow any vehicle to be parked, on the grass or landscaping of the Property. Tenant further agrees that, with the exception of non-material amounts of household cleaning supplies, Tenant shall not place nor suffer to be placed any hazardous or toxic material in, upon, or under the Property or conduct any activity which would bring the Property within the regulation of any federal, state, or local environmental law, rule, or regulation.

6. UTILITIES AND LAWN CARE. During the Term hereof, Tenant shall be responsible for contracting for in Tenant's name, maintaining and paying for all water, garbage, sewer, electricity, gas, phone, cable, internet, and other utilities or services to the Property. Tenant, at Tenant's expense, shall maintain the lawn and yard at the Property. If Tenant fails to maintain the lawn and yard in a satisfactory manner, Landlord shall be entitled to provide such lawn care at Tenant's expense.

7. TAXES. Landlord shall pay all real estate taxes, legal assessments, or other obligations relating to the Property, except Tenant shall pay personal property taxes assessed against [any mobile home on the Real Property and] any of Tenant's personal property located upon the Property during the term of this Lease.

8. PETS. Pets may not be kept at the Property without Landlord's prior written consent, which may be withheld in Landlord's sole discretion. If authorized, a pet deposit may be required.

9. ASSIGNMENT OR SUBLETTING....
