11.4 SAME-SEX MARRIAGE
Civil unions or other domestic partnerships entered into validly in other jurisdictions between same-sex couples are, by statute, void in Virginia. Further, any contractual rights created by such civil unions are void and unenforceable. 30 However, in light of the United States Supreme Court ruling in Obergefell v. Hodges, 31 recognizing a fundamental right for unrelated adults to marry, the constitutional viability of the Virginia statute is questionable.
