§ 1.2.1 Justices and Judges. Supreme court justices and court of appeals judges each serve a term of six years. If a justice or judge desires to be retained in office, he or she must file a declaration with the secretary of state not less than 60 nor more than 90 days before the regular general election next preceding the expiration of the term. See ARIZ. CONST. art. VI, § 38(A). By majority vote, the electorate then decides whether the justice or judge, whose name is placed on the ballot under a nonpartisan designation, shall be retained in office. Id. § 38(B). A vacant judicial office is filled by appointment by the governor from a list of not less than three nominees submitted by the commission on appellate court appointments. Id. § 37(A).
