1-13 Sample Settlement Agreement³⁵⁴

This Confidential Settlement Agreement and Release ("Agreement") is entered into by and between __________ ("Plaintiff") and __________ [Attorney] and __________ [Law Firm] ("Defendants"). In this Agreement, each may be referred to individually as a "Party" or collectively as the "Parties." The effective date ("Effective Date") of this Agreement shall be the last date on which the Parties execute this Agreement, as indicated on the signature pages hereto.

Recitals

Whereas, Plaintiff has filed a lawsuit against Defendants styled [insert style of case], Case No. __________, in the __________ Judicial Circuit in and for __________ County, Florida.

Whereas, each Party is represented by counsel and recognizes its respective rights and obligations, and is desirous of settling fully and finally any and all claims which were or could have been brought;

Whereas, prior to signing this Agreement, each Party had an opportunity to or has had counsel review this Agreement and explain that Party's rights and obligations under, and the legal effect of, this Agreement;

Whereas, the Parties have signed this Agreement of their own free will and volition, with full recognition and understanding of their respective rights and obligations under, and the legal effect of, this Agreement;

Now therefore, in consideration of the mutual promises and covenants contained herein and other good and valuable consideration, the receipt and adequacy of which is hereby expressly acknowledged, the Parties agree as follows:

Terms

1. Payment

The Parties have agreed to settle all disputes between them relating to any claims that Plaintiff contends it ever had, now has, can, shall, or may have against the Defendants and to exchange mutual general releases in exchange for payment in the amount of $ __________. 2. Release
