1-1 Introduction

In 2013, the Texas Legislature enacted the Texas Uniform Trade Secrets Act (TUTSA), which fundamentally revised the cause of action for trade secret misappropriation in the state. Three years later, in April 2016, President Obama signed a bipartisan law—the Defend Trade Secrets Act of 2016—establishing a new federal cause of action for trade secret misappropriation. These notable changes to Texas and federal law high-light the central role that claims for trade secret misappropriation play in business litigation t oday. Because modern technology now permits employees easy access to confidential information from virtually any location, trade secrets claims are fast becoming a central concern for business litigators in Texas and across the country.
