§ 9.4.1 Statement of Costs and Objections

Prior to January 1, 2017, Ariz. R. Civ. P. 54(f)(1), and A.R.S. § 12-346 were virtually identical; both provided that a party claiming costs must file and serve on the opposing party a verified statement of costs within ten days after judgment, unless the court extended the deadline for good cause. The opposing party could file objections to the statement and serve them on the party claiming costs within five days after receiving the statement. The court then ruled on the validity of the claim for costs.

The Arizona Supreme Court revised Rule 54(f) effective January 1, 2017. See generally In re Amended Rules of Civil Procedure (All), No. R-16-0010 (Ariz. Sup. Ct. Sept. 2, 2016). The new deadline for filing a request for an award of taxable costs depends on whether the party seeking costs is also filing a motion for attorneys' fees. If the party requesting taxable costs is also filing a motion for attorneys' fees, then the verified request for an award of taxable costs must be filed on the same day the party files its motion for attorney's fees under Rule 54(g). If a party seeking costs does not also seek attorneys' fees, then the deadline for seeking taxable costs depends on the nature of the relief obtained or judgment sought. If a decision adjudicates all claims and liabilities in the lawsuit and judgment is to be entered under Rule 54(c), then any request for costs must be filed within 20 days of the decision, or by any other date that the court may order.
