§ 7.9.3 Mootness. The defense of mootness applies to special actions. See Miceli v. Indus. Comm’n, 135 Ariz. 71, 73, 659 P.2d 30, 32 (1983) (statutory special action). The exceptions to mootness - significant questions of substantial importance and recurring issues that evade review - also apply. See id.; Simpson v. Owens, 207 Ariz. 261, 265, ¶ 13, 85 P.3d 478, 482 (App. 2004); Montero v. Foreman, 204 Ariz. 378, 380 n.3, ¶ 4, 64 P.3d 206, 208 n.3 (App. 2003) (court will address merits of claim when public interest would be served by deciding questions presented).
