§ 5.4 TECHNICAL REQUIREMENTS

§ 5.4-1 Format

The format to be followed in preparing a complaint or other pleading is set forth in UTCR 2.010 and includes the following requirements:

(1) Pleadings must be double-spaced, on 8.5-by-11-inch paper with numbered lines. UTCR 2.010(2), (4).

(2) The name of the court must not be less than two inches nor more than four inches from the top of the document. UTCR 2.010(4).

(3) Paragraphs must be numbered consecutively in the center of the page with Arabic numerals. UTCR 2.010(8).

(4) The title of the document must include the identification of the filing party. UTCR 2.010(11).

(5) Documents must include the author's name, address, telephone number, fax number (if any), and, if prepared by a lawyer, the name, bar number, and email address (if any) of the author and the trial attorney assigned to the case. UTCR 2.010(7);

Lawyers are encouraged to use both sides of each sheet of paper filed. Documents printed on both sides may not be refused. ORS 7.250(1). All documents to be filed should be printed on recycled paper, if available, although a court may not refuse a document that is not printed on recycled paper. ORS 7.250(2).

§ 5.4-2 The Caption

The caption of the complaint must include the following:

(1) the name of the court;

(2) the title of the action, which must include the names of all the parties and indicate the type of claim (such as "Negligence—Personal Injury," "Breach of Contract," or "Foreclosure—Mechanic's Lien"); and

(3) a designation indicating that the pleading is a complaint.
