§ 5.3.5 Other Factors Considered by the Courts. In determining whether to exercise their discretion to entertain actions for declaratory judgment, the federal courts have considered several factors other than those already discussed. Those factors include: (1) the prevention of gratuitous interference with state court litigation, tax collections, or law enforcement, Samuels v. Mackell, 401 U.S. 66, 91 S. Ct. 764, 27 L.
