§ 5.17 Outline of Procedural Steps and Time Limits. After the ICA or an ALJ has mailed an award, the following steps are necessary for appellate review.

1. Request for review filed.

A. Any dissatisfied party files with the ICA within 30 days after award has been mailed to parties. See A.R.S. §§ 23-942(D), 23-943. Jurisdictional.

B. An optional response is filed within 15 days after the request is filed. See A.R.S. § 23-943(A).

C. Decision on review affirming, reversing, rescinding, modifying or supplementing the award, generally within 60 days after the request for review is filed. See A.R.S. § 23-943(F).

2. Petition for Special Action-Industrial Commission and writ of review filed and served.

A. Petitioner files petition for special action-industrial commission and writ of review in division one within 30 days after decision on review is mailed to petitioner. See A.R.S. §§ 23-943(H), 23-951(A); RPSA 10(a)-(b). Jurisdictional. Filing fee should be paid at time of filing and must be paid within 10 days of notice from division one’s clerk. See A.R.S. §§ 12-321(B), 12-322(A).

B. Court clerk immediately issues the writ of review to the ICA with a 10-day return date. See A.R.S. § 23-951(B); RPSA 10(c).

C. The court clerk serves all other parties with copies of the writ.

D. Petitioner must serve other parties with copies of the petition and promptly file proof of service with division one. See RPSA 10(d).

3. Notice of appearance by respondent.

Respondent files notice of appearance and pays appearance fee within 10 days after the date of service of the petition. Notice of appearance must request any affirmative relief desired. See RPSA 10(f). Timely request for affirmative relief necessary for court to grant relief.

4. ICA forwards complete file to court of appeals within 10 days after service of writ of review. See RPSA 10(c).

5. Briefs filed.

A. Petitioner files opening brief within 30 days after return date of writ of review. RPSA 10(h), but cf. ARCAP 15(a)(1) (must file opening brief within 60 days after the appellate clerk mails or otherwise distributes an initial notice under ARCAP 12(b)).

B. Respondent files answering brief within 40 days after petitioner’s opening brief is served. See ARCAP 15(a)(2).

C. Petitioner files reply brief, if at all, within 20 days after respondent’s answering brief is served. See ARCAP 15(a)(3).

6. Oral argument requested.

A. Any party may file a request for oral argument within 10 days of the earlier of the date the reply brief is due or filed. See ARCAP 18(a).

B. Court clerk issues notice of oral argument at least 20 days before oral argument. See ARCAP 18(a).

7. Statement of costs on review.

A. Prevailing party files statement within 10 days after the clerk has notified the parties of a decision. See ARCAP 21(b)(1).

8. Motion for reconsideration in court of appeals.

A. Any party may file motion within 15 days after filing of decision by appellate court. See ARCAP 22(c).

9. Petition for review by supreme court.

A. Any party to RPSA 10 special action may file a petition for review within 30 days after court of appeals has filed its decision or, when motion for reconsideration is filed, within 15 days after final disposition of the motion or within 30 days after the court of appeals’ decision, whichever is later. See ARCAP 23(b)(2)(A) and (B). Filing fee must accompany petition, which is filed with the clerk of the supreme court. See A.R.S. § 12-120.32(B); ARCAP 23(b)(1).

Any other party may file cross-petition for review with the clerk of the supreme court within 15 days after service of petition for review or within 30 days after the court of appeals’ decision, whichever is later. ARCAP 23(b)(2)(C). Filing fee also must be paid with filing in supreme court. See A.R.S. § 12-120.32(B).

C. Court of appeals clerk makes available to the supreme court clerk the briefs the parties filed in the court of appeals and other portions of the record requested by the supreme court or its staff attorneys. See ARCAP 23(i).

D. Response to petition or cross-petition filed in the supreme court may be filed within 30 days from the date when petition or cross-petition is served. See ARCAP 23(f). Filing fee must be paid with filing in supreme court. See A.R.S. § 12-120.32(B).

10. If petition for review is granted.

Order granting review may permit supplemental briefs, set oral argument or both, which also may be requested by a party within 15 days after the supreme court clerk distributes notice to the parties of the order granting review. See ARCAP 23(k)(3) and (4). Upon notice from supreme court that review has been granted, the court of appeals clerk shall make the remaining record available to supreme court clerk. See ARCAP 23(g).

11. Costs on petition for review.

A. Prevailing party files statement of costs in supreme court within 10 days after notice of supreme court disposition. See ARCAP 21(b)(1).

12. Motion for reconsideration filed in supreme court.

A. Any party may file in supreme court within 15 days after filing of appellate disposition. See ARCAP 22(c).

13. Appellate court mandate.

The appellate court issues its mandate at the conclusion of all appellate court proceedings. The file is then returned to the commission for any necessary further proceedings. See generally ARCAP 24.
