§ 5.1.3 Interaction of State and Federal Laws. Like many other uniform acts, the Arizona Uniform Declaratory Judgments Act contains a provision requiring construction of the Act consistent with “. . . its general purpose to make uniform the law of those states which enact it, and to harmonize [it], as far as possible, with federal laws and regulations on the subject of declaratory judgments and decrees.” Compare A.R.S. § 12-1845 with the Arizona Uniform State Antitrust Act, A.R.S. § 44-1412 . Although no Arizona court, in reliance on this section of the Declaratory Judgments Act, has cited federal authority to support its interpretation of the Act or justify a result in a declaratory judgment action, federal cases are likely to be persuasive authority in areas where no Arizona state precedent controls.
