§ 4.8 Other Statutes

There are a number of other attorneys' fee provisions specifically directed at litigation involving government entities. These include: Arizona Constitution Article 28, § 6 (attorneys' fees may be awarded to one who prevails against the state, any governmental entity or political subdivision in enforcing Article 28, English as the Official Language,); A.R.S. § 12-1130 (attorneys' fees may be awarded to any party other than the state or a city, town, or county or any other political subdivision of this state, in a condemnation action to acquire owner-occupied residential property); A.R.S. § 12-1135 (attorneys' fees may be awarded to a property owner who prevails in any eminent domain action to be not for a public use; in any action for the purpose of slum clearance and redevelopment; a property owner shall be awarded reasonable attorneys' fees in every case in which the amount offered was less than the amount ascertained by a jury or court; a prevailing plaintiff in an action for just compensation that is based on diminution in value may be awarded reasonable attorneys' fees); A.R.S. § 13-420 (granting reasonable attorneys' fees and costs to "a party that prevails" in the defense of any civil action based on conduct (including law enforcement conduct) that is "justified" under A.R.S. §§ 13-401 to -421); A.R.S. § 35-213(C) (attorneys' fees may be recovered in an action in which a taxpayer prevails by the recovery of state monies illegally paid) ); Cain v. Horne, 220 Ariz. 77, 84, ¶ 31, 202 P.3d 1178, 1185 (2009) ("Once this matter is final, [plaintiffs] must be reimbursed for their expenses and reasonable attorneys' fees not to exceed forty per cent of the amount saved by the State by way of this action.").
