§ 4.3.1 This Article's Scope. This article explores the employment-related aspects of the Employee Retirement Income Security Act of 1974, as amended.¹ Discussion is directed primarily at the three aspects of ERISA most likely to be encountered by those whose labor and employment law practice does not include a significant focus on employee benefits. These three areas are: the scope of ERISA coverage, ERISA preemption, and the special issues involved in ERISA litigation, including the ERISA antidiscrimination rules as they apply to employment relationships.

This article provides some basic guidelines for the Arizona practitioner. The scope of ERISA material excluded from this discussion significantly exceeds the scope of material selected for inclusion.
