§ 37.3.5.3 Scope of Review By the Superior Court. The grounds for appeal and the legal standards governing the inquiry by the superior court pursuant to the ARA are whether the order was founded on or contained error of law, specifically including errors of construction or application of any pertinent rules; was unsupported by any evidence as disclosed by the entire record; was materially affected by unlawful procedure; was based on violation of a constitutional provision; or was arbitrary or capricious.
