§ 37.3.4.6 The Decision. The personnel board must make its decision on the appeal in an open meeting within 45 days after the hearing is concluded. A.R.S. § 41-783(E). However, the hearing is not deemed concluded until the hearing officer receives the transcripts of the hearing. The hearing officer must prepare and submit findings of fact, conclusions of law, and a recommendation to the personnel board within 30 days of the conclusion of the hearing. A.A.C. R2-5.1-103(E). The parties have the right to file proposed findings of fact and conclusions of law with the hearing officer. A.A.C. R2-5.1-103(P). The hearing officer’s recommended findings and conclusions must be transmitted to the parties. A.A.C. R2-5.1-103(P). Within 10 days of the receipt of the hearing officer’s report, a party may file written objections with the personnel board and serve copies on all other parties. No post-hearing evidence may be submitted. Id.
