§ 37.3.3 The Board’s Appellate Jurisdiction - Appeal of Disciplinary Actions. Except as provided by A.R.S. § 41-1830.16 for covered full authority peace officers, a covered employee who has completed the original probationary period of service may appeal the dismissal from covered service, suspension for more than 80 working hours or involuntary demotion resulting from disciplinary action to the personnel board. A.R.S. § 41-783(A); A.A.C. R2-5B-502. An employee who is not in covered service may not obtain personnel board review pursuant to A.R.S. § 41-783. McCleod v. Chilton, 132 Ariz. 9, 643 P.2d 712 (App. 1981).
