§ 36.3.7 Special Statutory Hearing and Appeal Provisions. Decisions of the commissioner relating to land exchanges and road rights-of-way exchanges are subject to two potential reviews. First, before state land or road rights-of-way can be exchanged under A.R.S. § 37-212, the commissioner must classify the land as suitable for exchange. The commissioner’s decision to classify state land as suitable for exchange is appealable to the board of appeals. A.R.S. §§ 37-204(C), 37-204(C)(8) and 37-215(C)(5). Second, the commissioner’s final decision regarding land exchanges and road rights-of-way exchanges are subject to review and a hearing before the OAH. A.R.S. §§ 37-606(C) and 37-616(C).
