§ 35.01 Introduction

Rule 807 recognizes a residual hearsay exception—variously described as the catchall or open-ended exception. When the Federal Rules were enacted, there were two residual exceptions—Rule 803(24) and Rule 804(b)(5). In 1997, they were combined in Rule 807 because they were redundant.1
