§ 32-11 Products Liability - Design Defect - In General
A product can be defective because of a flaw in its design. A product which is manufactured as intended may be defective where it is improperly or inadequately designed. A defective design involves a failure or inadequacy in a product's design or plan. Liability for a design defect may be based on negligence, strict liability, or warranty.
