§ 3.3.4.2 Source of Jurisdiction. As a court of limited jurisdiction, the court of appeals has only the jurisdiction conferred on it by the state constitution or by statute. See, e.g., Baca v. Don, 130 Ariz. 222, 635 P.2d 510 (App. 1981); Campbell v. Arnold, 121 Ariz. 370, 371, 590 P.2d 909, 910 (1979). Any lack of subject matter jurisdiction cannot be waived. See, e.g., Lightning “A” Ranch Venture v. Tankersley, 161 Ariz. 497, 499, 779 P.2d 812, 814 (App. 1989). However, “jurisdiction” exists over technically defective appeals, enabling an appellant to cure the problem. See Boydston v. Strole Dev. Co., 193 Ariz. 47, 50, ¶ 14, 969 P.2d 653, 656 (1998).
