§ 3.3.3.1.6 Mootness. Although Arizona courts are not constitutionally constrained to consider only “cases” or “controversies,” they typically decline to consider moot or abstract questions as a matter of judicial restraint. However, they may elect to consider issues that have become moot if there is either an issue of great public importance or an issue capable of repetition yet evading review. See Kondaur Capital Corp. v. Pinal Cty., 235 Ariz. 189, 191, ¶ 7, 330 P.3d 379, 381 (App. 2014). Special action jurisdiction also is proper to consider a moot issue when the issue is of great public importance or likely to be repeated in future cases. See Star Pub. Co. v. Bernini, 228 Ariz. 490, 492, ¶ 3, 268 P.3d 1147, 1149 (App. 2012).
