§ 3.21 Exclusions - Pollution

In Foremost Signature Insurance Co. v. Parker,¹³² the court addressed the application of a pollution exclusion in a mobile home policy. The insureds sought coverage for injuries sustained when an individual who was staying on their property attempted to light a gas oven in a camper/motor home and an explosion occurred causing severe injury to the individual and her children.¹³³ The insurer brought a declaratory judgment action seeking a declaration that the policy did not afford coverage for a number of reasons, including that the policy's pollution exclusion operated to preclude coverage.
