A. [§ 3.142] Indirect Proof under McDonnell Douglas Standards

The models of proof used in employment discrimination cases are instructive in wrongful discharge cases. Brandon v. Molesworth, 104 Md. App. 167, 655 A.2d 1292 (1995), aff'd in part and rev'd in part, 341 Md. 621, 672 A.2d 608 (1996). As with Title VII claims, a claim of wrongful discharge can be established either by direct evidence or, in the absence of direct evidence, by the proof scheme developed by the Supreme Court in McDonnell Douglas Corp. v.
