§ 21.9 RECEIVER'S AUTHORITY AND POWERS

Common law contains a distinction between general receivers and custodial receivers. The receiver's authority and powers in a general receivership are greater than the receiver's authorities and powers in a custodial receivership. However, that scope is not well defined in the case law and is only discernable from reviewing the facts and circumstances of each case. In practice, the line between these two types of receivers can be very difficult to locate.
