§ 2.4.12 Organizational Rights. Section 2 of the RLA places a duty on any United States attorney to whom an employee representative applies for filing enforcement proceedings. This includes the organizational rights set forth in the guarantees to employees and unfair labor practices by carriers. The rights guaranteed by the RLA are enforceable in federal court.⁶⁷ Even before this express enforcement language was added in the 1934 amendments, the Supreme Court had held that the organizational rights were enforceable in court.
