§ 2.4.10 Unfair Labor Practices. The RLA's protection of employees' right of self-organization affects the parties in three distinct phases: (1) while employees are seeking to organize or to replace or displace an incumbent representative; (2) during the ongoing relationship between a carrier, the employees and their representative; and (3) during periods of self-help. Somewhat similar to the National Labor Relations Act, certain rights and unfair labor practices are set forth in the law.

Section 151(a)⁵⁰ sets forth that one of the purposes of the law is to forbid any limitation upon the freedom of association among employees or any denial, as a condition of employment or otherwise, of the right of employees to join the labor organization. It also provided for the complete independence of carriers and of employees of self-organization to carry out the purposes of the RLA. After setting forth the purposes, the RLA prohibits interference, influence or coercion by either an employer or a union over designating representatives.⁵¹ The provision also sets forth that unions cannot interfere with carriers in the carriers' choice of representative.
