§ 19-18 Contract - Repudiation as Breach

A repudiation is:

(a) a statement by the obligor to the obligee indicating that the obligor will commit a breach that would of itself give the obligee a claim for damages for total breach; or
(b) a voluntary affirmative act which renders the obligor unable or apparently unable to perform without such a breach.

An absolute repudiation of a contract by one of the parties to the contract constitutes a breach of the agreement for which the repudiating party is liable in damages. The refusal of a party to recognize the existence of a contract, or the doing of something inconsistent with its existence...
