§ 15.16 SEX-OFFENDER CLASSIFICATION AND RELIEF

Persons found GEI, and who are required to register as sex offenders, are classified upon completion of a risk assessment. Classification is assessed by the PSRB, with an assigned level of one, two, or three. ORS 163A.100. Level one represents the lowest risk of recidivism. This information is released to the Oregon State Police. ORS 163A.105(5). However, registrants meeting certain eligibility requirements may apply to the PSRB for relief from registration, or to request reclassification to a lower level. ORS 163A.105(7).

In 2018, the PSRB completed risk assessments for all sex offenders who were, or had been, under its jurisdiction. The evaluation and assignment of risk scores to those placed under the PRSB's jurisdiction since that time is ongoing. Assessments must be completed no more than 90 days after the person is conditionally released or discharged by either the court or the PSRB. ORS 163A.105(3)(a).

If, upon receipt of the assessment, the person is rated as a level two or three, and disagrees based upon a factual mistake, an appeal to the PSRB may be filed within 60 days. That appeal is limited to the factual questions underlying the classification. ORS 163A.105(6)-(7). An individual who...
