§ 13-17 Damages - Immature Crops

If you find the immature or growing crops of the plaintiff were damaged as a result of the defendant's alleged negligent conduct, the proper measure of damages is the difference between the value of the probable crop had there been no injury and the value of the actual crop, less expenses of preparing for market the portion of the probable crop prevented from maturing. Alternatively, damages may be computed by using the following elements:

(1) the rental value of the land;
