§ 1.2 DEFINITION OF OFFENSES

The Oregon Criminal Code generally governs prosecution of, and punishment for, "any offense." ORS 161.035. An offense is any "conduct for which a sentence to a term of imprisonment or to a fine" is provided by state or local law. ORS 161.505.

An offense is classified as a crime or a violation. ORS 161.505. "A crime is an offense for which a sentence of imprisonment is authorized." ORS 161.515(1). A violation is an offense punishable by only a fine, or a fine plus additional punishment, if the punishment "does not include a term of imprisonment." ORS 153.008(1)(b)-(c).

§ 1.2-1 Classification of Crimes

A crime is a felony if it is so designated or if it is punishable by imprisonment of more than one year. ORS 161.525. A crime is a misdemeanor if it is so designated or if it is punishable by imprisonment of one year or less. ORS...
