State law impermissibly denies California-born transgender individuals who reside outside of the state the right to a new California birth certificate that in-state transgender individuals have, the California Court of Appeal has ruled.

The plaintiff was born in California in 1941. In 2005, she underwent gender reassignment surgery to become a female. She then legally changed her name and obtained a new driver's license in her state of residence, Kansas.
