The U.S. Supreme Court has agreed to decide whether a conviction based on conduct that took place in part before a criminal statute was enacted violated the Ex Post Facto Clause of the Constitution.

The defendant met a woman on an online chat room devoted to sadomasochism in 1998. Over the next year, they two were involved in an alternative sexual lifestyle known as bondage, dominance/ discipline, submission/sadism and masochism.
