Summary

A woman forced out of a church-affiliated hospital's pastoral education program can't sue under the ADA - the hospital did not waive its right to invoke the "ministerial exception" by adopting a non-discrimination policy, the 6th Circuit has ruled.

The plaintiff was forced to leave the program, which was run by a Methodist hospital, based on a psychological test which relied on dream analysis. She sued under the ADA, claiming the program waived its right to rely on the First Amendment's "ministerial exception" when it agreed to a non-discrimination policy in order to win accreditation from a national association for pastoral programs.
