A child pornography suspect's open acknowledgement that he might destroy his computer justified the warrantless seizure of the device by police, the Utah Supreme Court has ruled in reversing a suppression order.
Police investigating Internet crimes discovered that child pornography had been downloaded through an IP address belonging to the defendant. When officers went to the defendant's home to conduct an interview, the defendant refused their request that he hand over his computer. Acknowledging that he might be in "trouble," the defendant suggested to officers that he would be better off if he simply destroyed the computer.See the full content of this document
