Oregon Court of Appeals Rules Disability Policy Covers Business Continuation Costs

Summary


A doctor is entitled to disability coverage to cover his office overhead expenses even though he stopped seeing patients, the Oregon Court of Appeals has ruled. The plaintiff was an urologist with an "overhead expense disability" insurance policy providing up to $120,000 in coverage for "overhead expenses" in operating his practice should he become disabled. The policy also noted it would provide benefits of up to $10,000 per month.

The urologist became totally disabled and applied for coverage. He became unable to see patients and de-activated his state license. However, he kept his office open to collect bills and handle mail and to keep the business going for when he was able to practice again.
